Arizona Set-Aside vs Record Sealing

Arizona does not offer broad “expungement” for most convictions the way some states do. Most people are looking at a set-aside, sealing, or — in limited situations — marijuana expungement.

Set-Aside (Often Called “Clearing” A Conviction)

A set-aside asks the court to set aside a judgment of guilt after you finish the sentence requirements. It can help with some background checks and civil rights issues, but it does not erase the case from existence. Eligibility and timing depend on the offense and your record.

Record Sealing

Sealing limits who can see certain case records. It is different from a set-aside and has its own rules about which cases qualify and when you can apply. Some employers, agencies, and courts may still have access depending on the situation.

Limited Marijuana Expungement

Arizona law now allows expungement for certain marijuana-related offenses that would be legal under current rules. That path is narrower than a general “wipe my whole record” option.
