When no aggravating factors apply, assault is typically a misdemeanor. The misdemeanor class can depend on the mental state and type of act alleged. Your complaint controls the exact wording.

Aggravated assault is assault plus one or more aggravating circumstances listed in Arizona’s aggravated assault statute, for example serious physical injury, use of a deadly weapon or dangerous instrument, certain injuries such as a fracture, strangulation allegations, or assaults on protected categories of victims. Aggravated assault is a felony; the felony class depends on the specific paragraph charged.

When a case is also tagged domestic violence

If the alleged victim is a household member, romantic partner, or another person covered by Arizona’s domestic violence relationship rules, the State may add a domestic violence designation. That designation can affect release conditions and other consequences even when the underlying assault is still a misdemeanor.

What is the difference between assault and aggravated assault in Arizona? Assault is the basic offense and is usually a misdemeanor when no aggravating factors apply. Aggravated assault adds statutory aggravators (for example, serious injury or a deadly weapon) and is charged as a felony. The exact subsection on your complaint matters.

Will this show on a background check if I am only charged, not convicted? Arrests and pending charges can appear in some background checks even before a conviction. A charge is not a conviction, but you should not assume a pending case is invisible. Ask us about your specific paperwork.

What if the other person does not want to press charges? In Arizona criminal cases, the State, not the alleged victim, decides whether to file or continue a prosecution. Someone who “does not want to press charges” can still be subpoenaed as a witness. Do not contact the alleged victim in violation of a release condition or order; call us first.
